1. Definitions
“Confidential Information” means information provided by one party to the other in written, graphic, recorded, or any other form concerning the business, student contact information, all Course Materials and Course video lessons.
“Course Materials” means all of the information provided in a course by Pinky Jangra, in any format and in hard copy or electronic form, as part of the Services.
“Fees” means the fees paid by you to Pinky Jangra for the Services.
“Intellectual Property Rights” means copyright, rights in or relating to databases, patent rights, performers’ rights, designs and registered designs, trademarks, rights in or relating to Confidential Information and other intellectual property rights (registered or unregistered) throughout the world.
“Online Course” means the delivery by us of an online course pursuant to which you learn course materials remotely.
“Services” means the provision of the Online Course and/or the Course Materials together with such other services as agreed from time to time and purchased by you through the Website.
“Website” means https://pinky-jangra.thinkific.com and the individual Course URL's contained within this parent Website URL.
“you” means the individual purchasing the Services.
2. The Services
2.1 We will provide the Services with reasonable care and skill in accordance with the description set out on the Website.
2.2 We reserve the right to vary or withdraw any of the Services described on the Website without notice.
2.3 We do not make any guarantee to you that you will obtain a particular result from your purchase and completion of any of the Services.
3. Disclaimer
3.1 The Services provided by Pinky Jangra are for educational purposes only. The Services are not psychological counselling or any type of therapy, and should not be construed as such.
3.2 By purchasing the Services you agree that the Services will not be used by you as a substitute for treatment by a Medical Healthcare Professional regarding healing of trauma, mental illness or related health problems that you are experiencing.
3.3 You agree that results achieved by you as a result of using the Services are entirely your responsibility. In no event does Pinky Jangra accept liability for lack of results or adverse results experienced by you after using the Services.
3.4 By purchasing the Services you accept that you are wholly responsible for verifying that the Services are suitable for your requirements.
4. Ordering Services
4.1 In order to purchase any of the Services on-line you must register for an account with us via the Website. If you already have an account with us, you can log into your account using your user name and password.
5. Intellectual Property
5.1 All Intellectual Property Rights in the Course Materials, Online Courses and the speeches made by trainers are, and remain, the intellectual property of Pinky Jangra or its licensors, whether adapted, written for or customised for you.
5.2 You are not authorised to:-
(i) copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the Course Materials and related Course content
(ii) record on video or audio tape, relay by videophone or other means the Online Course
(iii) use the Course Materials in the provision of any other course or training
(iv) remove any copyright or other notice of Pinky Jangra on the Course Materials
(v) modify, adapt, merge, translate, disassemble, decompile, reverse engineer any software forming part of the Online Courses.
5.3
(i) Breach by you of clause 5.2 shall allow us to immediately terminate these terms and conditions with you and cease to provide you with any Services, including but not limited to access to the Online Courses.
(ii) Legal action for compensation may be taken against you for any breach under 5.2. Such legal action will be governed under English Law.
5.4 In consideration of the Fees paid by you, we grant to you a limited, non-transferable, non-exclusive access to use the Course Materials in respect of the Online Course for the sole purpose of completing the Online Course.
6. Confidentiality
6.1 Each party shall keep the other party’s Confidential Information strictly confidential and not use it otherwise than for the purposes of these terms and conditions.
6.2 Either party may disclose Confidential Information to its legal and other advisors for the purposes of obtaining advice from them.
6.3 This clause shall continue notwithstanding termination of these terms and conditions.
7. Force Majeure
Pinky Jangra Services reside on the Thinkific course platform. Pinky Jangra shall not be liable to you for any breach of its obligations or termination under these terms and conditions arising from causes beyond its reasonable control, including, but not limited to, Thinkific operational malfunctions, internet malfunction impeding your access to your account, natural disasters, terrorism, hacking, Government edict or regulation, or any other factors that may impact the functioning of the course platform, or your access to your course, and which are beyond the control of Pinky Jangra.
8. Assignment
We may assign, transfer, sub-contract any of our rights or obligations to any third party at our discretion.
9. Data Protection
9.1 When you register with us you will need to provide certain data such as your contact details. We will store this Data and use it to contact you, provide you with details of the Services you have purchased and otherwise as required during the normal provision of the course.
9.2 We use your name and email associated with your account, to enable us to identify whether you are using our services, assist with the provision of services and to ensure that you have access to relevant products.
10. Law and Jurisdiction
This Agreement is subject to English law and the parties submit to the exclusive jurisdiction of the English courts in connection with any dispute hereunder.
